Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy describes how HealthMaxxing LLC ("HealthMaxxing," "we," "our," or "us") collects, uses, and shares Consumer Health Data covered by the Washington My Health My Data Act. It applies to Washington residents and to Consumer Health Data collected in Washington.
1. Consumer Health Data We Collect
Depending on the features you choose, we may collect the following categories of Consumer Health Data:
- Body measurements, characteristics, goals, and related health or fitness inferences, including age, sex, height, weight, desired weight, activity level, and progress.
- Nutrition and dietary information, including food logs, calories, nutrients, dietary preferences, allergies, medications, and relevant medical history you choose to provide.
- Physical activity, exercise, sleep, recovery, vital-sign, and connected-device information.
- Mental and emotional wellness information, including mood and mind check-ins, journal or reflection content, and information associated with voice memos. Voice memo audio remains on your device.
- Menstrual-cycle and reproductive-health information, including period and symptom entries, when you choose to use cycle tracking.
- Photos and other content you choose to provide for health, nutrition, journal, or progress features.
- Health-related requests, AI inputs and outputs, manually submitted corrections, and inferences generated to provide features you request.
2. Sources of Consumer Health Data
We collect Consumer Health Data from:
- You, when you enter information, upload content, complete check-ins, or request a feature.
- Your device and the App, based on the features you use and information created through those features.
- Apple Health or Health Connect, only after you grant the applicable device permission.
- Service providers acting on our instructions when they return information needed to provide a feature you requested.
3. Why We Collect and Use Consumer Health Data
We collect and use Consumer Health Data to:
- Provide the tracking, logging, connected-device, cloud backup, synchronization, and wellness features you request.
- Personalize goals, summaries, recommendations, and other in-app experiences.
- Provide AI-powered features only when you choose to use them.
- Maintain, secure, troubleshoot, support, and improve the App.
- Comply with law and protect users, HealthMaxxing, and the integrity of the service.
- Create aggregated or deidentified information where permitted by law. Deidentified information is maintained so it cannot reasonably be linked to a consumer or device, and we do not attempt to reidentify it.
4. Consumer Health Data We Share
We do not sell Consumer Health Data. We do not share Consumer Health Data with data brokers, advertising platforms, or analytics providers. We disclose limited Consumer Health Data to processors acting under our instructions when necessary to provide a feature you request:
- Google Firebase: account-linked Consumer Health Data you choose to back up or synchronize through your private cloud profile.
- Cloudflare and Anthropic: the limited health or wellness information needed for an AI feature you choose to use, transmitted through our secure proxy for processing.
- Apple Health and Health Connect: only the categories you direct HealthMaxxing to read or write through device permission controls.
We may also disclose Consumer Health Data when you specifically direct us to do so, when you provide separate consent where required, or when disclosure is required by law. HealthMaxxing has no affiliates with which it shares Consumer Health Data.
5. Your Consumer Health Data Rights
Subject to applicable law, you may:
- Confirm whether we collect, share, or sell your Consumer Health Data and access that data, including a list of third parties and affiliates with whom it was shared or sold.
- Withdraw consent for future collection or sharing where our processing relies on consent.
- Request deletion of your Consumer Health Data from our systems and from processors or other recipients as required by law.
- Appeal a refusal to act on one of your requests.
You may request deletion through the controls under Profile > Settings > Account. To exercise any right, including access or withdrawal, email privacy@maxxing.health with the subject “Washington Consumer Health Data Request” and describe the right you want to exercise. We may take reasonable steps to authenticate your request. To appeal a decision, use the subject “Appeal — Washington Consumer Health Data Request.” We will respond within the time required by applicable law.
6. Changes to This Policy
We will update this Policy before collecting, using, or sharing new categories of Consumer Health Data or using Consumer Health Data for new purposes. Where required, we will obtain affirmative consent before the new collection, use, or sharing begins.
